What you can (and can't) deduct
You can deduct unpaid rent, repair costs for damage beyond ordinary wear and tear, and cleaning beyond a reasonable level. You cannot deduct for ordinary wear and tear — faded paint, minor carpet wear, small nail holes, etc.
Documentation matters
Photograph the unit at move-in and move-out. Keep all repair receipts. Send the itemized statement by certified mail with the refund check. If you skip these steps, courts often side with the tenant.
Penalties for missing the deadline
Most states penalize landlords who don't return the deposit on time — often 2-3× the wrongfully withheld amount, plus the tenant's court costs. Set a calendar reminder for the day after move-out.
